The exhibitions and the auctions are public and open to all, in the auction room and on the Internet with registration specifying the rights and obligations on Drouot Live which broadcasts the live sale www.drouotlive.com which broadcasts the live sale or on www.hdv-lausanne.com.
The purpose of the Lausanne Auction House is to gather and interest as many potential buyers as possible in order to sell to the highest bidder property entrusted on behalf of and for third parties.
Thus, preliminary exhibitions were held in the premises of Drouot at 12 rue Drouot 75009 Paris and this day at Palace Spa Grand-Chêne 7-9 1003 Lausanne.

The fact of participating in the auction implies that all buyers or their agents accept and adhere unconditionally to all these terms of sale. They are deemed to act in their name and on their behalf:

Art. 1 - The auction is made strictly for cash, its conduct and its auction is in euros and Swiss francs. Before the beginning of the auction, he is given a booklet with a personal number of bidder to each person who wishes to be purchaser. It allows to bid and to be recognized. This number also makes it possible to automatically and immediately establish the bill (bill) payable at the end of each session. The auctioneer reserves the right to refuse bids from persons who do not have the bidder's license plate.

Art. 2 - The minimum amount of overbids is set at 10%.

Art. 3 - The Auction House held legally to respect the reserve prices recorded in the reports of his estates inventories and in the contract validated for all other causes of auctions. Art. 4 - The auctioneer has the right to change the order of the lots and to separate, regroup or withdraw batches.

Art. 5 - The auctioneer also reserves the right to refuse an auction and / or the award of a lot.

Art. 6 - The highest bidder and the last bidder of a lot will be the winning bidder.
In case of double bidding, resulting in a dispute between two bidders in the room and / or on the phone and / or live on the Internet, a real recognized litigation by the auctioneer, the lot will be immediately auctioned.

Art. 7 - The payment of purchases can be made by transfer, bank card or cash up to CHF 100'000 or in Euros at the exchange rate on the day of the sale. The Auction House is free to accept or refuse payment by certain credit cards. For EC-Direct and Postcard direct debit cards, they are accepted free of charge. The Maestro direct debit card will be subject to a surcharge of 0.50% and credit cards, Visa and Mastercard an increase of 2.30% of the total amount debited as part of a portion of the fees collected. by the issuer of the card.
American Express and other credit cards are not accepted.
Cheques are not accepted.

Art. 8 - Selling costs 20% in addition to the hammer price (21.6% with VAT).

Art. 9 - For a VAT amount higher than CHF 50, any foreign buyer exporting his lot can apply for a VAT refund on sending export documents validated by Swiss customs. For batches No. 1 to 121 on temporary admission, they will be definitively imported if the buyer is resident in Switzerland or they will be shipped from the seller's country to the country of the buyer with the application of the Swiss exemption legislation. VAT. The lots of No. 1 to 121 are temporarily imported into Switzerland and therefore subject to a 5.5% charge to the Swiss resident purchaser in addition to selling expenses and the hammer price.

Art. 10 - The buyer becomes the owner of the lot only at the time of his complete payment.

Art. 11 - Purchased lots must be removed and packed at the risk of the buyer.

Art. 12 - Fifteen days after the sale and without notice, the lots paid and not withdrawn, will be stored in storage and stored at a minimum charge of CHF 30 per month, at the risk of the buyer.
The buyer or principal expressly agrees that the undelivered lot becomes the property of the Auction House and the carrier for re-sale as soon as the storage costs mentioned exceed the price of the low lot estimate.

Art. 14 - The exhibition allowing the purchasers to realize the state or the authenticity of the lots, it will not be admitted any complaint once the adjudication pronounced. Art. 15 - Any visitor of the exhibition and the sale is responsible for the average price of estimate increased of the commissions and VAT of the damages that it causes, directly or indirectly on the exposed lots.

Art. 16 - The orders of purchases sent by the site www.hoteldesventes-lausanne.com are executed with discretion and graciously by the Auctioneer. They must arrive no later than the day before the sale. In case of identical purchase orders, the priority will be given on the first order received.
In case of equality with a buyer present in the room, priority will be given to the latter who has moved. Any cancellation must be in writing and at least 24 hours before the sale.
To be valid, the order must bear the signature and stamp of the management of the Auction House.
The Auction House does not have to take into account a purchase order and will not assume any liability if it was not executed.

Art. 17 - Phone auctions are accepted subject to bank guarantees, but the Auction House declines all responsibility for any connection problems or any failure in the execution of an offer, for any reason.

Art. 18 - Any dispute relating to the sale is subject to the exclusive application of Swiss law and to the jurisdiction of the courts of the Canton of Vaud, regardless of the place of the auction and the domicile of the parties.
However, the Auction House shall have the right to act at the domicile or the place of business of the buyer, or any other competent court.
Recourse to the Federal Court is reserved.
