TERMS AND CONDITIONS OF AUCTION SALES ON DROUOT ONLINE
The auction and the online posting on the DROUOT website are automatically managed by the company DROUOT SI.
This is therefore an auction conducted exclusively online, without exhibition and without public sale.
Account Creation: Each User must read and accept, without reservation, the General Terms of Use of DROUOT SI by means of a checkbox validation mechanism when creating an Account or registering for a Sale.
Only natural persons who are at least 18 years of age and have full legal capacity are authorized to use the DROUOT platform.
Protected adults may access it provided they have obtained authorization from their legal guardian with respect to the maximum bidding amount and the lot desired.
The creation of an Account is limited to one per Professional User and one per Individual User on the DROUOT Platform.
The Account Creation Process is divided into several steps described on the DROUOT Platform, during which the User will be required to provide personal information, banking details, and identity documents appropriate to the nature of their Professional or Individual User Account.
The data collected is necessary to secure transactions and, if necessary, to verify the source of funds. Any identity document is collected and verified securely by DROUOT SI’s service provider specializing in identity verification.
It is then encrypted and stored by this service provider on the servers of its hosting provider, Google Cloud Platform. Banking data is collected and stored securely as described in Article 8 (conditions of sales by DROUOT SI).
This ensures the security of transactions and the validity of bids.
Any incomplete, erroneous, or illegible Account Creation Process will be rejected by DROUOT SI.
Automatic Bidding: A Bidder may place an Automatic Bid on the DROUOT platform, setting the maximum purchase price of a lot, of which HÔTEL DES VENTES DE LAUSANNE SA has no knowledge. This constitutes a firm commitment to purchase made by the Bidder in the event of adjudication in their favor.
The sale consists exclusively of works by contemporary artists: These artists themselves enter, via a personalized online code, the descriptions, photos, estimates, and reserve prices of their works.
Therefore, the descriptions and the presentation of photos on the site are the sole responsibility of the artists.
In addition, these artists are obliged not to sell or exhibit their works during the entire duration of the sale.
The sale is conducted in euros, and the applicable taxes and fees are also in this currency.
The works sold are shipped directly by the artists to the buyers.
Accordingly, since HÔTEL DES VENTES DE LAUSANNE SA has not entered into a sales mandate with the sellers (the artists), it bears no legal obligation in the transaction between sellers and buyers.
