The fact of participating in the auctions of the Hôtel des Ventes de Lausanne in LIVE WITH OR WITHOUT prior EXHIBITION and this, electronically, by telephone or by purchase order, implies that all buyers or their agents accept and adhere unconditionally to the present conditions of sale. They are deemed to act in their name and on their behalf:
Live sales with or without prior exhibition are sales broadcast live on the websites of the Hôtel des Ventes de Lausanne.com, Drouot.com and Invaluable.com.
On this, the participant via one of these two platforms must read and accept without reservation their conditions of use, which are independent and are added to the present general conditions of LIVE sales WITH OR WITHOUT EXHIBITION of the Hôtel des Ventes de Lausanne.
Art. 1 - The auction is held strictly in cash and without guarantee, its conduct and award is in Swiss francs or euros and visible in other currencies instantly on the exchange table visible on the Internet.
Art. 2 - Payment for purchases can be made by bank transfer or in cash with a maximum of 100,000 Swiss francs or 100,000 Euros.
L'Hôtel des Ventes is free to accept or refuse payment by certain credit cards. Visa and Mastercard debit cards will be subject to a surcharge corresponding to 2.3% of the total amount debited as a contribution to part of the fees collected by the card issuer.
American Express and other credit cards are not accepted. Checks are not accepted.
Art. 3 - The buyer pays a 25% drop in addition to the hammer price of each lot, plus VAT of 8.1% on this drop, i.e. 27.03 (buyers domiciled outside Switzerland are exempt). These sales fees are increased by 1.5% for purchases by Drouot Live and 5% by Invaluable.
Art. 4 - The hammer will be pronounced in favor of the last bidder. The word "Sold" closes the sale. In the event of a dispute at the time of the hammer, it will be canceled and the lot immediately put back up for sale.
Art. 5 - The Auction House is legally required to respect the reserve prices recorded in the reports of its estate inventories and in other causes of requisitions for auctions. The auctioneer is therefore required to bid on behalf of the sellers, and when this price is not reached, he moves on to the next lot by a simple hammer blow. Unsold lots may be awarded by mutual agreement after the sale at the sole discretion of the auctioneer.
Art. 6 - The auctioneer has the right to change the order of the lots and to separate, group or remove lots, at his sole discretion.
Art. 7 - The auctioneer has the right to refuse an auction and/or the award of a lot.
Art. 8 - The highest and last bidder of a lot will be the successful bidder. In the event of a double bid, resulting in a dispute between two bidders in the room and/or on the telephone and/or live via the Internet, a dispute recognized as real by the auctioneer, the lot will be immediately put back up for auction.
Art. 9 - LIVE sales WITH EXHIBITION allow buyers to see the condition or authenticity of the items, no complaints will be accepted once the hammer has fallen. The auctioneer is at your disposal before LIVE sales WITH OR WITHOUT EXHIBITION to provide you with information on the lots, their period, and their condition. The estimates, dimensions, colors of the reproductions and information on the condition of the lot are provided for information purposes only. This means that all lots are sold in the condition in which they are at the precise moment of their auction and no complaints of any nature whatsoever will be accepted, even if they relate to an incorrect description appearing in the catalog published on the websites of the Hôtel des Ventes de Lausanne, Drouot and Invaluable. The condition of the frames is not guaranteed, the usual restorations and relining are considered as conservative measures not leading to depreciation of the lots. Condition reports can be communicated on request, for information purposes and free of charge on simple request, by email or telephone.
Art. 10 - The buyer only becomes the owner of the lot at the time of its full payment.
Art. 11 - At the request of the buyers, the Auction House may recommend service providers likely to ensure handling, packaging, storage and transport. This recommendation will not engage the responsibility of the Auction House. It is the buyer's responsibility to have the lots insured as soon as they are awarded since from this deadline, the risks of theft, loss, damage or other are under his entire responsibility. The Auction House declines all responsibility for the damage itself or for the failure of the successful bidder to cover his risks against this damage.
Art. 12 - Any dispute relating to this sale is subject to the exclusive application of Swiss law and the jurisdiction of the courts of the canton of Vaud, regardless of the location of the auction and the domicile of the parties. From a legal perspective, the French text of these conditions of sale constitutes the only binding reference.
